These Terms of Service ("Terms") govern your access to and use of Uncloud, including our website, mobile applications, storage nodes, and related services (collectively, the "Service"), provided by MPSoftware ("Uncloud", "we", "us", or "our"). By creating an account or otherwise using the Service, you agree to be bound by these Terms.
The Service
Uncloud stores your files in one of two places. An Uncloud Storage Node is hardware you run (your own computer, or an Uncloud Storage Node device) that you reach remotely through the Uncloud network, without configuring port forwarding. Uncloud Cloud Storage, included with Uncloud Plus, keeps your files in storage we operate. Either way, files are encrypted on your device before they leave it. You are solely responsible for any hardware you connect to the Service and for keeping it operational, secure, and backed up.
Accounts
You must create an account to use most features of the Service. You agree to provide accurate information, keep your login credentials secure, and notify us promptly of any unauthorized use of your account. You are responsible for all activity that occurs under your account.
Acceptable Use
You agree not to use the Service to store or transmit content that is unlawful, infringing, or that you do not have the right to share, and not to attempt to disrupt, reverse engineer, or gain unauthorized access to the Service, other users' nodes, or our infrastructure.
Subscriptions and Payment
Uncloud Plus is a paid subscription that includes Uncloud Cloud Storage and other features. It renews automatically at the end of each billing period until you cancel. Subscriptions bought in the iOS app are billed and managed by Apple through your App Store account; subscriptions bought on the web are billed through our payment processor, Stripe, and managed from your account settings.
Free trials. New subscribers may be offered a free trial of Uncloud Plus (currently 30 days), once per person. Unless you cancel before the trial ends, your subscription starts and you are charged the price shown when you signed up. Cancelling during the trial ends access to Plus features, including uploading to cloud storage, when the trial ends.
Applicable fees, billing terms, and cancellation policies are presented to you at the time of purchase. Fees are non-refundable except as required by law or by the store you bought through.
Cloud Storage and Fair Use
Uncloud Cloud Storage is provided for your personal use, within the storage allowance of your plan. Uploads that would take you over your allowance are refused. We may change allowances, with notice for changes that reduce yours.
- Uncloud Plus includes up to 100 GB per account, including during a free trial.
- Free accounts may use up to 10 GB for 30 days from their first upload. This is meant as a place to start: after those days you can no longer upload, and you have 7 more days to import your files into your own Uncloud Storage Node, download them or upgrade to Uncloud Plus. After that we may permanently delete them. We may change or end the free allowance for new accounts at any time.
To keep the Service fast and affordable for everyone, you agree not to use cloud storage to:
- host or distribute files to the public or to large numbers of people, or serve it as a content delivery network;
- store data on behalf of other people or businesses, or resell or sublicense the storage;
- transfer data at volumes far beyond normal personal use, such as repeatedly downloading the same large files or running automated bulk transfers; or
- circumvent the storage allowance, for example by spreading data across multiple accounts.
Because files are encrypted before upload, we can't see what you store; we look only at volumes and patterns of use. If your use places an unreasonable load on the Service, we may contact you, limit transfers, or suspend uploads, and we will tell you why.
When your subscription ends. You can no longer upload to cloud storage, but you can still download, import into a storage node and delete your files for 30 days. After that we may permanently delete them. Deleting your account deletes your cloud files straight away. Files on an Uncloud Storage Node are unaffected: they stay on your hardware.
Content Ownership
You retain all rights to the files you store using the Service. We do not claim ownership of your content, and because files are encrypted before upload, we do not have the ability to access their contents.
Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that data loss will never occur, and we strongly recommend maintaining independent backups of any files you store on the Service.
Limitation of Liability
To the maximum extent permitted by law, MPSoftware will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from or related to your use of the Service.
Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service if you violate these Terms or if we discontinue the Service.
Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you through the Service.
